Sorry to hear your news OP. :(

I hope your physical recovery is speedy.

Thankfully you've been able to refute the speeding allegation - that may help with the other issue.

I got prosecuted 30+ years ago for DWDC & A which had a range of 2 to 8 points IIRC (frosted up screen) and sent the Court a grovelling apology. Managed to get only 2 points, but a £40 fine which was pretty painful back in the mid-80s!

I'm not sure how things work now, but good luck.

The problem may be if the OP totalled his van on the back of the other vehicle there may be a lack of evidence!

No dashcam to prove he had no rear lights? I know a very good specialist in this sort of thing if you are interested.

Sounds pretty terrifying Craig - glad you walked away, hope you get better soon. At least, unlike women, you shouldn't expect this sort of thing to happen regularly.

My wife's car was written off in an accident last week - she's ok, but I empathise with you having to go through / argue with insurance, police, getting a new vehicle etc., especially this time of year.

No Steve, apparently not...just want to fling the book at me,as I hit the back of the other vehicle!
They had me as excessively speeding, and were not interested in my opinion,or side of it.

Was very surprised,and annoyed,at getting done for anything,given I have proven I wasn't speeding !!

Will have to take the minimum 3 points for Careless driving,as it's 50/50 at me getting off,so to spesk,as much as getting a worse punishment/more points,by a grumpy Procurator Fiscal/Judge!!

Annoying thing too is, Scotland is the only part of UK that still doesn't have the option of Speed or Driver awareness courses instead of points.
Thank-you Scottish government for dragging your heels on that for 2 years or more :headbang:

ekimj10 wrote: Sun Nov 19, 2017 3:52 pm Is there not an option to attend an awareness course for the careless driving bit instead of the three points?
My other half got caught jumping a red light by 1.2 seconds an she attended a course in lieu of the points, it still cost £80 or so but worth it
Just a thought, best of whatever happens.
Not in Scotland, unfortunately.

You might want to get some specialist advice, the penalty is minimum 3 and maximum 9 points. You could easily get 6 for it if the police report is against you.

Speeding issue no longer an issue, proven I was only doing 46,in a 60.
Careless driving will be the minimum,3points.
Police were just tossers,tbh
