Parking Ticket

Post by Lynchy » Sun Apr 19, 2015 8:33 pm

On a little meet a couple of weeks ago in Rye I parked up in a car park at 08:37am but didn't purchase a ticket until 09:01am as we'd been standing around chatting.I only paid for an hour as I knew we would be back in time after breakfast but because we stood around chatting again my ticket ran out at 10:01am and I didn't leave the car park until 10:31am.Is it worth pleading my innocence or should I just pay the £40 fine.

When did you get the ticket Eddie?

Others who were there may also get caught by this as the cameras record your time in & time out - I can't remember if I bought a 1 or 2 hour ticket

Send them a cheque for the underpayment and £10 to cover their admin costs with an apology. If they pursue further ask them to prove their loss as a result of your underpayment.

They have sent you an invoice not a fine and they should only recover REASONABLE costs. They would need to sue you in a County Court for the difference where the judge would expect them to demonstrate their loss or that you entered into a contract with them and accepted their Ts & Cs.

If it's a council run car park then you'll struggle on those grounds. I had a ticket cancelled for a council car park but that was a whole different story.

If it's private then by all means go down the actual loss route, if you can be bothered with the hassle and having to put up a fight (with a possible court attendance).
