Has anyone ever registered a patent/copyright?

Post by Ducklakeview » Sat Jul 08, 2017 3:21 pm

Have had an idea, which I think would be of interest to the car manufacturers, TBH it just came to me in a flash as I overtook a Renault on the motorway earlier.

So, before I speak about it to anyone, I want to "protect my interests" so to speak..

Anyone done it and familiar with the procedure?

Mike

Mike,

You need to talk to a patent agent/lawyer . The first thing that they will do is a search to see if anyone else has registered a similar invention. They will help you write the patent application. The disclosure is quite formalised and to a a particular format (have a look at some on the web). This will cost you probably 2-3K. You need to decide if you are going for UK, Europe,USA or world=wide . Figure on adding a couple of K or so per addition. If the patent is granted then you have annual maintenance fees. Be aware though if it is a widget it WILL BE RIPPED OFF IN CHINA. Your best bet then may be to refrain from disclosure, make a zillion of them yourself and sell them before our chums in Shenzhen get one and copy it.

Just to clarify I'm an engineer/scientist not a lawyer.

Best of luck

I had a bit of my research IPd... Cost a bloody fortune. The initial cost are small but then as you go wider the cost spiral. And the upkeep gets huge expect 10s of k as you go through the world wide Ip

A friend of mine developed and patented various aspects of the 'Rimblade' wheel protector (not an arse razor as some jibbed), it's now sold all over the world including Wallmart USA and even offered as an oem option in some markets, which all sounds highly lucrative. However he spends a lot of his time and money litigating with everybody from Amazon to Beijing to try and stop the rip-offs that went in to production almost immediately. Unfortunately the copies are 5h1t and have damaged the reputation of the real thing, it's a nightmare TBH.

If I had a bright idea I'd see a patent lawyer and think about flogging/licencing it

As per Sean Connors sound and sage advice Mike.
I have a background in Engineering and NPD/NPI (New Product Development/Introduction) in a broad spectrum of industries covering nuclear, aviation, maritime and mechanical-handling.
Have registered many design patents in my time.
I'd suggest retaining the services of an established and reputable engineering consultant before even thinking about laying out 1000's capital on a world patent. They won't steal your idea but would provide you with suitable and invaluable feedback/consultation for feasibility considerations; design for engineering, assembly, serial manufacture, reliability, mean time to failure/failure mode, safety, certification, etc etc.
You could implement a non-disclosure agreement with them for added peace of mind and they may even offer this themselves initially. They could also even offer to part fund or contribute to any development costs. Prototyping can be particularly expensive...

Drop me a pm to discuss further if required....

Just a guess, but if Mike was passing a Renault when he had his Eureka moment hopefully it's a gadget we can fit to our cars so that we don't have to look at such horrible French aberrations when we overtake them - I'd be up for that!
