Trading Standards should be heavily involved. I would also ask if the car was advertised on the garage website. If so I would be looking at the wording and what exactly it was they were advertising. If any discrepancies, contact the advertising Standards Agency. They don't have the same teeth as Trading Standards but the more official agencies you have on your side the better.

2 years! :o

But I finally have an outcome to this saga, so I thought I would drop an update here as there is nothing worse than a thread without an end.

The z4 unfortunately was sold, as a 2 seater was fun, but not very practical when you have a daughter.

So after my last update, Barclays did refund part of my money for a short period, but VISA over ruled them after Car Firm challenged it and they took the money back frustratingly. This meant that I had to go the court route to get my money back, as Car Firm refused to engage in any form of communication with me about resolving this situation.

Cue 18 months of working through the court system. I will say this, the process is slow, if anyone ever gets to this situation themselves you really have to gut it out and power through as it can take its toll on you mentally, especially if you represent yourself like I did. 100% commitment to see it through as you can quite easily just shelve it and let them off scot free, which I think places like this hope you do when they refuse to engage.

Included in these delays were them trying to postpone the hearing twice, they were successful the first time, delaying it by 3 months but second time I finally got the hearing.

I won't get into the whole hearing but suffice to say the judge was skeptical from the get go and it just went downhill for them from then on.

Result

An absolute battering.
Full win for myself, including 2 years interest at 8%, all court fees, travelling costs, a day of my wage and hilariously the £8 parking parking fee for that day, which I thought was chefs kiss by the judge. It did seem like anything that could be added to the final bill was added. The judge also seemed to have prior dealing with them and was in no mood to listen to their nonsense all hearing.

In total they had to pay an extra £6.5k on top of the car value to myself. :D

What does all this mean for me?
Well once my daughter is a bit older I am probably going to be tempted back into a 2 seater, the z4 was fun when I had it so definitely an option for me to return to z4 ownership in the future. Right now though, armed with an unnatural love of fast v8 wagons and a wad full of cash I have just put a deposit down on a CLS63 AMG Shooting Brake. :P

The M6 is back up for sale with them, currently in Luton, so if anyone knows someone that was interested in that car, please direct them to this thread and hopefully it will avoid another person sharing the same fate. I will also be dropping a Google & TrustPilot reviews as well at some point.
 
Kudos to you for not sacking it off!!!

Have you got the cash back or are you waiting for them to actually pay up?

Funnily enough , the judge ordered an initial date for payment to be 24th September, they asked for 28 days to pay and kind of got into a back and forth about why they needed the 28 days, while the judge was not convinced. In the end I said I was happy for it to be 28 days, whcih would have meant a date of 8th October to pay.

They payed up on Friday and collected the car same day, bearing in mind the car hadn't moved for 2 years they didn't load it onto a truck or anything, they got in it and drove it all the way down to Luton. Prats.
 
Excellent outcome, albeit as you said a long time of aggro.
Hopefully cases like this where the public push back against these crooks will make them think twice when selling dodgy goods. I doubt it, though.

I had trouble with this dealer after reserving a car and then deciding I didn’t want it as it was terrible in the flesh. It took two months of deep persuasion to get my money back. All forums should black list this company.
 
I'm glad to hear you won your case.

Looking at their reviews they sound unbelievably bad. There is lots of fake positive reviews on Google to try and hide all the negative reviews.

Their Trust pilot rating has removed due to the amount of false reviews.

I read through a lot of their trust pilot reviews. Many are fake positives and pretty much the rest are similar to the OP's situation.
Seems like they have a lot of legal cases pending against them. People need to be careful they don't just dissolve the company to wriggle out of claims and start again.

It does make me wonder where they are getting so many crap cars from. You would think the law of averages would mean a few are decent.

The cheapest cars at the auction and the cheap cars from Gumtree, eBay and Marketplace that all require "£20 fixes". :rofl:

I don't know how a dealer car gets away with so many acts of fraud and ignoring consumer laws.

Customers need to report them to the local trading standards.

Because they know the worst that can happen is they lose in court and have to refund money. Chances are 90% of people don't go that far and just let it go. They will NOT go to prison, or be put out of business for their 'crimes'.
When the vast majority of the used car industry is shady and dishonest, it's tough to make an example of the really bad ones as there will be so many.

I hate car dealers, always have. I put them in the same bracket as estate agents. Talentless parasites. Money is the only language either of them speak.
 
When I bought my first home back in the late 70s they were pushing endowment mortgages. Because I was single and didn’t want one the estate agent that was dealing with me rang me and told me I was a bloody twat. I went elsewhere for my mortgage and he lost his commission. :thumbsup:
 
Pleased that you got your money back. Really sad to read that we have car dealers operating this way as it tarnishes it for the good ones. As much as some members on here dislike car dealers there are some good ones
