Parking fine

Post by obewan » Tue Oct 10, 2023 2:51 pm

It's an invoice not a fine.

Start the 'letter tennis' by asking how they've arrived at such a figure.
Say the car park wasn't full at the time you parked up (so the pub hasn't lost revenue). Offer £1.00 as a goodwill gesture
They'll soon get fed up as it will cost them more in time/effort/postage

But be careful not to admit any guilt because after all you had parked there for years without payment being necessary and the signs were not that visible. And if they refuse £1.00 offer then 50 pence

Is that still true? I thought there'd been a change in law some years ago that meant they've got actual clout now. All part of the same thing that means you can't ignore the letters any more, IIRC.

dr_john wrote: Tue Oct 10, 2023 2:08 pm Just had an email from the parking company, my appeal is rejected but the fine is reduced from £60 to £20. I’m tempted to pay it and hope that the pub may recover it.
Don't pay.

All the pub landlord has to do is contact the parking company and tell them to delete the charge.

PS. Yes it is still a charge and not a fine. Only the Police and local authority can issue fines.

The charge is for trespass on private land and the charge can only be issued by (Not on behalf of by a third party) someone who has a proprietary interest in the land. i.e. The owners of the land which these parking companies are not.

That argument is how I won both my cases with Parking Eye. I simply asked them and the land owner to provide proof that Parking Eye had part ownership of the land.

As far as I'm aware, yes
June '23 Moneysupermarket.com states

'Parking Charge Notice/PCN - Invoices issued by private companies for parking on private land
If you overstay in a supermarket, hospital or other private car park, you could end up with one of these. Despite the identical acronym, a Parking Charge Notice is different to a Penalty Charge Notice. The former isn’t backed by law. Think of it more as an invoice for breaking the terms and conditions of the private company which operates the car park.'

I would write back to the parking company and explain the circumstances; that you were using the patrons car park for it's intended purpose.
I would also write to the pub owners and explain the same.

If you used the pub car park purely for using the pub then no-one is going to take you to court. They may threaten it but they won't do it.
:thumbsup:excellent advice, maybe even try calling their bluff and explain that your considering taking them to court over this matter or if your not confident in the matter explain that due to the cost of living crisis you are willing to pay them ( so can't be done for refusing to pay) but it will have to be £1 a month. I'd send them 65 post dated cheques for a £1 and that way they have full payment. :fuelfire:

It’s over.

I received a letter from the parking company today cancelling the fine. No apology, but a happy outcome. :D

It seems that the pub landlord realised that the adverse publicity he was getting and loss of trade from disgruntled customers forced him to take action against the company, Civil Enforcement.
